The United States federal Earned Income Tax Credit (EITC or EIC) is a refundable tax credit; it is means tested, and designed to encourage low-income workers and offset the burden of U.S. payroll taxes. For tax year 2009, a claimant with one qualifying child can receive a maximum credit of $3,043. A claimant with two qualifying children can receive a maximum credit of $5,028. The credit is expanded for tax year 2009 and 2010. For claimants with three or more qualifying children, the maximum credit is $5,657. Grandparents, aunts, uncles, and siblings can also claim a child as their qualifying child provided they shared residence with the child for more than six months of the tax year. However, in tie-breaker situations in which more than one filer claims the same child, priority will be given to the parent. A foster child also counts provided the child has been officially placed by an agency or court. There is a much more modest EIC for persons and couples without children that reaches a maximum of $457.

A qualifying child can be up to and including age 18 at the end of the tax year, up to and including age 23 if classified as a full-time student for one long semester or equivalent, or any age if classified as “permanently and totally disabled” (one year or more).

Enacted in 1975, the initially modest EIC has been expanded by tax legislation on a number of occasions, including the more widely-publicized Reagan EIC expansion of 1986. The EIC was further expanded in 1990, 1993, and 2001 regardless of whether the act in general raised taxes (1990, 1993), lowered taxes (2001), or eliminated other deductions and credits (1986). Today, the EITC is one of the largest anti-poverty tools in the United States (despite the fact that most income measures, including the poverty rate, do not account for the credit).

Other countries with programs similar to the EITC include the United Kingdom (see: working tax credit), Canada, Ireland, New Zealand, Austria, Belgium, Denmark, Finland, France and the Netherlands. In some cases, these are small (the maximum EITC in Finland is 290 euros), but others are larger than the U.S. credit (the UK's working tax credit is worth up to £7782).

In the United States as of tax year 2006, some 20 states and the District of Columbia had their own EICs. These state plans generally mimic the federal structure on a smaller scale, with individuals receiving a state credit equal to a fixed percentage—generally between 15 and 30 percent—of what they are eligible to receive from the federal credit. A few small local EICs have been enacted in San Francisco, New York City, and Montgomery County, Maryland.

Will the tax rebate checks help those with earned income tax credit?
Q. could some one please help me? Will the proposed tax rebate be available to those that have recieved the "earned income tax credit"? I have a family of 4 and we earn less than $45,000 a year. would we still qualify for the tax credit? or are we disqualified? further explaining: we recieved a refund of over that amount... and it is me and my husband and two kids.

A. The credit will not impact your rebate. Your rebate depends on your 2007 taxes and income. Under the compromise bill passed by the Congress, you would be eligible to receive a rebate of up to $1200 if you paid that much in Federal Income Tax. If you only paid $750 in taxes (less than the $1200 rebate limit), you only get back $350. If you had earned income of at least $3000, you would get at least the minimum rebate of $300. If you qualify for a rebate, you would also get $300 for each dependent child. While the rebate depends on your 2007 income, it is actually a rebate toward your 2008 taxes. According to the proposed plan, in 2008, taxes would be cut from 10 percent to zero percent on the first $6,000 dollars of taxable income for… [cont.]

What if i make just over the amount qualifying me for the earned income tax credit?
Q. I did some preliminary tax prep and it looks like I made around $10 bucks too much to get my earned income tax credit. No fair, this is the first year I would ever be able to get close to claiming it. And that's only because I got laid off in Nov. Dang I've been paying taxes for years, too!

Can I claim my child for the earned income tax credit if my ex claims her for a deduction?
Q. I know someone who says she claimed her children every year on her taxes as dependents for a tax deduction, while her ex husband also claimed them every year to get the earned income tax credit. Am I misunderstanding what she said or is it possible to do this?

A. You used to be able to do this, one parent claims for the hoh exemption amount and the other for EIC. However, I believe that this year the IRS is not allowing this and only one person can claim the child for all credits and exemptions.
